Of Service.
These Terms govern your use of customdrops.co.uk and any order you place with Custom Drops UK. By using this site or placing an order, you agree to them. Our Privacy, Refund and Shipping policies form part of these Terms.
01 Eligibility
You must be at least 18 years old (or have the consent of a parent or guardian) to place an order. By ordering, you confirm you have legal capacity to enter into a binding contract with us.
02 Orders & Contract Formation
When you place an order, you are making an offer to buy. We confirm receipt by email — that is not yet acceptance. A binding contract is only formed when we accept your order by sending a proof for approval, or by dispatching your item, whichever comes first.
We reserve the right to refuse, cancel or refund any order at our discretion — including for suspected fraud, payment problems, unlawful or infringing artwork, pricing errors, or stock unavailability.
03 Pricing
All prices are shown in GBP (£) and are the total price you pay for the goods. We try to keep prices accurate but errors happen. If we discover a pricing error after you place an order, we will contact you to confirm at the correct price or cancel and refund.
Shipping is shown at checkout. International customs and duties are not included — see the Shipping Policy.
04 Payment
Payment is taken in full at checkout via Shopify Payments, PayPal, Klarna, Apple Pay, Google Pay or other listed methods. We do not see or store your card details. By submitting payment you confirm you are the authorised cardholder.
05 Proof Approval
For every personalised item we send a digital proof for approval before production. By approving the proof:
- You confirm the design, text, colours, sizing and placement are exactly as you want.
- You authorise production exactly as shown.
- The order can no longer be cancelled, changed or refunded except as set out in the Refund Policy.
If you do not respond to the proof within 14 days, we may cancel the order and refund the goods (minus setup fees), or continue to chase you for approval.
06 Artwork, Designs & Copyright
You are responsible for the artwork you upload. By submitting any artwork, design, logo, photograph, text or other content ("Customer Content") to us, you represent and warrant that:
- You own the Customer Content, or you have all necessary rights, licences, permissions and consents to reproduce and distribute it on physical garments.
- The Customer Content does not infringe any third party's intellectual property rights (copyright, trade mark, design right, image rights, or any other), and is not defamatory, obscene, threatening, hateful or otherwise unlawful.
- You will indemnify, defend and hold harmless Custom Drops UK, its owners, employees and agents against any and all claims, losses, damages, fines, costs and legal fees (including reasonable solicitor's fees) arising out of or related to your Customer Content.
Our role is purely production. We act as a print bureau. We do not check, vet or verify the rights you have in the artwork — that is your responsibility. If we receive a copyright, trade-mark, design-right or other IP infringement notice in relation to an order, we will:
- Forward the notice in full to you, the customer who placed the order.
- Cooperate with the rights holder as required by law, including providing your order and contact details.
- Stop producing or shipping the item in question.
- Refund only at our discretion and only after the matter is resolved.
You agree that you, not Custom Drops UK, are the responsible party for any infringement claim relating to your design.
07 Product Accuracy & Tolerances
We aim to match your approved proof as closely as possible, but please note:
- Colours on screens vary between devices and between RGB digital files and CMYK printed output. Some colour shift is normal and not a fault.
- Print or stitch position may vary by up to approximately 10mm. This is a manufacturing tolerance, not a defect.
- Garments are made by different suppliers — slight variation in shade, fit and finish between batches is normal.
- Embroidery cannot reproduce fine detail or photographic gradient. If your design is unsuitable we will tell you at proof stage.
08 Cancellation
Personalised goods are exempt from the standard 14-day cooling-off period under Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may cancel only up to the point you approve the proof. After that, the order is in production and cannot be cancelled.
09 Acceptable Use Of The Site
You agree not to:
- Use the Site for any unlawful purpose, or to upload unlawful, infringing, harmful or malicious content.
- Interfere with the Site's operation, attempt to gain unauthorised access, or upload viruses or malicious code.
- Scrape, copy or republish the Site's content, images or product photography without our written permission.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
10 Our Intellectual Property
All content on the Site (excluding Customer Content) — including logos, branding, product photography, mockups, text, layout and code — is owned by Custom Drops UK or our licensors and is protected by copyright, trade-mark and other laws. You may not reproduce, distribute, modify or create derivative works without our written permission.
11 Limitation Of Liability
To the maximum extent permitted by law:
- Our total liability for any single order is limited to the amount you paid for that order (excluding shipping).
- We are not liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill, loss of opportunity or loss of data.
- We are not liable for delays or non-performance caused by events outside our reasonable control (force majeure), including but not limited to fire, flood, strike, courier failure, pandemic, government action, internet outage, raw-material shortage or supplier failure.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under English law (including under the Consumer Rights Act 2015).
12 Fraud & Abuse
We treat fraud seriously. Our family has a background in law.
Where we have reason to believe a customer has acted fraudulently — including false non-delivery claims, false damage claims, fraudulent chargebacks, abuse of refund rights, or use of stolen payment details — we reserve the right to:
- Refuse to fulfil current and future orders.
- Block your IP address, email, phone and delivery address from our systems.
- Pursue full recovery of the value of goods, courier costs and our reasonable legal and administrative costs through the County Court or other appropriate channels.
- Share fraud intelligence with other businesses, card networks and law enforcement.
- Publicly call out clear fraud (within the limits of UK defamation law), including on TikTok and other social platforms.
13 Indemnity
You agree to indemnify, defend and hold harmless Custom Drops UK, its owners, employees and agents from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from or related to:
- Your breach of these Terms.
- The Customer Content you submit.
- Your misuse of the Site or our products.
- Your violation of any law or third-party right.
14 Suspension & Termination
We may suspend or terminate your access to the Site, refuse to accept orders, and cancel any pending orders, at any time and without notice, if we reasonably believe you are in breach of these Terms or engaged in unlawful activity.
15 Changes To These Terms
We may update these Terms from time to time. The date at the top shows when. Continued use of the Site or placing a new order after changes are posted means you accept the updated Terms.
16 Severability & Entire Agreement
If any provision of these Terms is held to be unlawful, void or unenforceable, that provision is severed and the remaining provisions stay in full force.
These Terms, together with our Privacy, Refund and Shipping policies, form the entire agreement between you and Custom Drops UK relating to your use of the Site and any orders.
17 Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales.
